Terms and Conditions
I (the client) understand that by accepting the services provided by EZ Deals that I/we are bound by the terms and conditions provided herein.
SERVICES PROVIDED.
EZ Deals uses proprietary software to provide marketing campaigns to our clients. We do not sell or lease out any software to our clients.
Every campaign comes with custom-made images to help our client’s business with selling their specific products and services (our custom-tailored campaigns will work for any business that provides a service or sells a product).
1. Digital Marketing: EZ Deals will create a custom digital marketing campaign based on our client’s specific needs.
a) Digital Interactive Campaigns. EZ Deals creates digital interactive campaigns with the odds of winning controlled by our clients. Our campaigns include scratch, slot machines, spinning wheels and our classic design. Our campaigns are fun and interactive. The prizes are digital coupons and are generally discounts, giveaways (i.e. client branding coupons, movie tickets, vacation trips, third party gift cards, certificates, free merchandise, etc.). Our client determines the number of prizes and the odds of winning offered in any given promotion. The number of pricing / odds has seven options for the spinning wheel, up to six options for the slot machine and the scratch campaigns and one option for the classic campaign. When a consumer wishes to redeem their digital coupon, then our client must validate (i.e. If you receive a new credit/debit card in the mail, you will need to activate it in order to use it). Our EZ Deals widget validation process activates the customer (consumer’s) digital coupon and it will be ready to use.
b) Digital Loyalty Rewards Programs. EZ Deals provides two different digital loyalty rewards options. One acts like a punch/stamp card and the other is a “frequent buyer” points program.
c) Electronic Stampers. This is a physical device programmed for validating the winning prize (digital coupon) on the consumer’s smartphone and validating the EZ Deals digital loyalty reward programs.
d) NFC (Near-Field Communication) Hardware.
EZ Deals have available two NFC devices: 1) A digital business card as a key tag containing the NFC circuitry. This can be conventionally attached to a keychain. 2) An adhesive sticker containing the NFC circuitry that can be stuck to any suitable surface, and is typically attached to campaign advertising posters.
NFC (Near Field Communications) hardware enables compatible devices to transmit information over short distances. With this technology, one device transmits information while the other receives it. Our NFC devices enable the instant transfer of information traditionally found on conventional printed business cards, to suitable smartphones and other devices, simply by bringing them into close proximity. The transmitted digital business card should of course include all of your important internet links and of course a link to your EZ Deals campaign!
Our NFC stickers and keycards also feature your unique printed campaign QR code, allowing use with virtually all smartphones and devices.
e) Beacons – Beacons allow users to push ads to those within a certain distance. Beacons leave a cookie on the devices of mobile device users in proximity to the beacon and ads will appear via one of more than 150 apps. NOTE: On December 6th, 2018, Google ended its support of the Nearby Notify program. This has created a lag in the time this information is delivered. Beacons are from a third-party vendor and are leased to EZ Deals clients. EZ Deals is not responsible for changes in technology related to the beacons. In case the EZ Deals client has their own mobile app, the results will be in real time integrating these two.
NOTICE TO CLIENTS: WE ONLY ACCEPT PAYMENT ONLINE THROUGH EZ DEALS. ALTERNATIVE PAYMENT ARRANGEMENTS CAN ONLY BE MADE DIRECTLY WITH OUR CEO MR. ONNE VAN DER LAAK. IF ANYONE REQUESTS PAYMENT BY ANY OTHER MEANS, CONTACT US IMMEDIATELY. You stand to lose any payment not made through the correct channels, as well as your campaign and/or hardware supplied by EZ Deals.
All prices are subject to change without notice at any time unless the EZ Deals client has signed an agreement with us.
2 Digital Campaign, Landing Page, Interactive Website design management.
One-time setup fee and pricing: There is a $399 one-time setup fee plus a monthly subscription. Both charges should be paid upfront unless there is a country/county/province/state restriction or a special promotion. The setup fee includes:
i. The programming and design for your campaign are based on your chosen online order form submission and the visual layout from our development team.
ii. Hosting of the campaign by EZ Deals, facilitating easy access.
iii. Easy to share URL Code with SEO, to integrate on any digital site.
iv. Digital Poster design, for printing or use on websites.
v. QR Code.
vi. Campaign Digital Images.
vii. Digital Social Media Images.
viii. Validation Software and App.
ix. Digital Flyer Pad Image.
x. Our Marketing Expert Consultation and Orientation training.
Month-to-Month Agreement – $874 monthly. This subscription includes an active campaign for 30 days from the date of going live, Advertising banners on internet sites, and apps for 30 days. Live analytics and monthly statistic reports by request. Also included is the option of a free monthly consultation with us to update the campaign and advertising segmentation to adjust prizes, odds of winning, images used, etc.
We have an additional one-time-only discount option to pay for 6 months upfront and receive 1 month free for a total of 7 months (DOES NOT INCLUDE THE EZD BOOSTING). Unless EZ Deals receives a “put-on-hold notice,” this automatically becomes a month-to-month payment. A campaign put on hold incurs a $50 monthly charge from when we receive back all rented hardware. The pausing or cancellation of a campaign requires 3 business days from the client by submitting the following online cancelation form: https://b24-3t4ol7.bitrix24.site/feedback/
MOST POPULAR OPTION: Pay for 12 months up front and receive 3 months free for a total of 15 months (also a one-time opportunity option) (DOES NOT INCLUDE THE EZD BOOSTING). This will become a month to month automatically, unless EZ Deals receives a put-on-hold notice ($50 monthly upon receiving back all hardware) or a cancellation notice from the client via email 3 business days prior to the due date. Any additional updates to the client’s campaign are charged at the hourly rate of $59 for utilizing our creative department or $79 for utilizing our developers for any additional programming to our client’s website and social media pages (i.e. campaign gift card / poster and URL integrations, etc.).
II. Our digital campaign is also considered a landing page and interactive website all in one with a stand-alone URL. No mobile app is needed for any users/consumers to utilize the campaign. Our custom designed campaigns are created uniquely and specifically for each of our EZ Deals clients’ individual needs.
III. URL encoding is the practice of translating unprintable characters or characters with special meaning within URLs to represent something that is unambiguous and universally accepted by web browsers and servers. These characters include ASCII control characters, unprintable characters typically used for output control. This unique URL is created for each campaign only. Additional locations will require their own URL and will be an additional charge.
IV. A digital poster is created for each campaign so that our client can print it out in any size to create campaign awareness and use (i.e. wall/window poster, menu item, website special, etc.)
V. A QR Code (short for “quick response” code) is a type of barcode that contains a matrix of dots. It can be scanned using a QR scanner or a smartphone with a built-in camera…for example, scanning a QR Code with your phone might open a URL in your phone’s web browser. This unique QR Code is created for each campaign only. Additional locations will require their own QR Code and will be an additional charge.
VI. The background image is created for the home page of the classic and scratch campaigns. Utilizing the NFC hardware technology like a digital business card, the client can share their BIO or About Us page instantly.
VII. The social media images are 2 different images in size. The bigger image is for the EZ Deals client to place within their website header attaching their campaign URL which becomes viewable on each page so each visitor (consumer) can click on the image to get involved with the campaign. The smaller image is always used for Facebook. If or when requested by the EZ Deals client, this image will be seen on every consumers’ Facebook timeline since they must share their winnings before they are able to redeem their coupon. The EZ Deals client must also add one of those images into their email signatures, attaching their campaign URL. If the EZ Deals client expects a Return on Investment (ROI) guarantee they MUST follow everything mentioned in point VII.
NOTE: All Images created are only provided in JPG or PNG format. If the client wishes to receive the files in a different format for editing purposes, they must pay extra as per a quote that will be provided by the EZ VISUAL Team.
VIII. EZ Deals provides a Validation Widget for our EZ Deals clients in order to receive analytics and statistics when consumers fill out information. The client will enter the URL provided in the web browser, to take them to the Validation Page: https://www.validationwidget.com/?l=7600 and then will put in their unique code. We require each client to fill in their own made-up code on the EZ Deals order form for each campaign/location. Validation is necessary to receive accurate analytics of their Return on Investment and to help prevent fraud.
IX. The flyer pad image can be printed out (just like the poster image in point IV). This will work best for e-commerce and take out/to go businesses as well as anyone wanting to advertise their business products and services. Sometimes EZ Deals will give FREE sample flyer pads as a special promotion to our EZ Deals clients.
X. The analytics will be received by the EZ Deals client each time the consumer/customer shares their winning (prize) on their Facebook timeline, or fills out the custom questionnaire requested by our EZ Deals client. Every time there is a validation, our EZ Deals client will receive validation notifications via email. For more analytics options, please contact EZ Deals directly. Unless the EZ Deals client requests access to their own statistics, they will not receive the monthly statistic reports. If requested, the statistics will be received monthly from EZ Deals before or on the 15th of each month for the prior month.
3.Additional Pricing and Services:
a) Additional Service Pricing: The following services and prices have 50% off applied for clients who exclusively get at least one Gamified Digital Campaign. The clients who don’t get at least one Gamified Digital Campaign will pay double for each of the following prices.
i. Loyalty Program – $49 Monthly + a one-time setup fee of $75
ii. Adding a Location/Department – $49 Monthly + a one-time setup fee of $99 (this one-time setup fee is good up to 5 locations/departments).
iii. Adding Campaign(s) – $99 Monthly + a one-time setup fee of $99 (per each additional campaign).
b) Hardware Pricing:
i NFC Key Tag – $20 Monthly (no setup fee).
ii Digital Validation Stampers – $49 Monthly + a one-time setup fee of $75 (per each additional stamper). Minimum 3-month period of obligation when ordering stamper(s).
iii NFC Sticker – $15 Monthly (no setup fee).
c) Hardware Pricing Information choosing a one-time Special.
i Shipping costs are not included, and the additional funds will be charged to the EZ Deals client the day of shipping.
ii EZ Deals client 6/12-month special purchase options: Pay for 6/12-months up front receiving a discount with receiving free additional month(s); the EZ Deals client must still pay the full subscription for the monthly hardware and additional ordered services. (i.e. pay for your campaign 12 months up front and receive 15 months, the client will pay the remaining 3 months for the additional hardware and services.)
iii All lost hardware will result in costing the EZ Deals client $100 per lost device (this excludes NFC stickers):
4 All expired agreements will revert to monthly automatic payments unless we receive a hold notice or cancellation in writing via email. Any holds will require the following up front charge:
a. $50 per campaign putting the campaign on hold
b. $25 per stamper putting the stamper on hold
c. $10 per additional putting a product and service on hold
5 In case EZ Deals receives a non-sufficient funds or no payment EZ Deals will charge the client additional internal, 3rd party and late fees:
a. $50 internal work
b. $10 per day for late fees
c. $34 for each 3rd party fee
6 Any amount unpaid due to expired agreement, fee to put a campaign or device on hold, credit card payment declined, or invoice that is unpaid on the due date will, by right and without notice of default, equally entail additional damages that by convention are determined at 10% of the invoice amount with a minimum of $125.00 without prejudice to the right of EZ Deals to prove its judicial and extrajudicial costs, incurred by any payments overdue, and to claim payment.
All HARDWARE is from third-party vendors and is leased to EZ Deals clients:
a. NFC Hardware – Attract and engage customers with the EZ Deals NFC-enabled proximity marketing solution. Instantly tap-and-learn without having to configure a connection.
b. Validation Stamper – Every stamper is uniquely identifiable to your campaign. Stamps make it simple to engage customers and encourage brand loyalty. Loyalty: Ditch the punch-card and integrate our EZ Deals stamper into your workflow. User identified by cell number or email, collect stamped information for loyalty and mobile marketing. Coupons: Why fuss with paper when you can redeem a digital coupon utilizing our stamper to map the customer journey based on user, time, and location. Ticketing: Redeem, validate and track the lifecycle of a ticket. Utilize our stamper to map the customer journey based on user, time, and location. Events: The biggest client of the year might just be standing right in front of you. Stamp their event passport, share valuable information and drive traffic to your event location.
ADDITIONAL SERVICES
EZD Boosting: Our generation programmatic advertising system is included in our standard monthly subscription ($349) and can be used to develop a pixel for your website that will take a minimum 4 months
EZ WEB: EZ Deals Web Development & Design Service.
EZ WEB PRICES:
*Using EZ Deals Hosting service, a 3-page informative website is $599 and a Ecommerce website with 5 pages and no more than 100 Products added is $1599. plus 80 USD annually.
*Using Other hosting and website builder such as WordPress, Elemento, Wix or other, a 3-page informative website is $799 and a Ecommerce website with 5 pages and no more than 100 Products added is $1799.

EZ Deals creates Websites using our client’s specifications, texts, images, videos, and Logos. After we receive this information and files, we will start designing. The clients have 7 days to send the complete information. After that, we will design with what we have.

Our clients must provide us with the credentials or admin access to their hosting provider and website builder if they decide not to use our EZD Hosting. The clients must purchase the domain. If the client selects the $1599 E-commerce website, they must supply the API transaction key from the merchant provider for the payments and the Shipping API of the selected carrier company. An e-commerce website will have 5 pages and 100 listed products, adding more pages or products will be extra as per our hourly. If the client selects the informative $599 website, this website will have no more than a total of 3 pages. An extra informative page will have an additional cost of 50 USD.
Once all of the above has been provided EZ Deals will deliver the website within 20 days and our client has 3 business days to notify us of any necessary modifications concerning the color, or position of images, text, and information to be displayed.

Additional widgets, plugins, forms, pages, or web support requested will be charged separately at our standard hourly rate of 79 USD.
*For Clients using the EZD Hosting, you will be charged 80 USD annually. Please be aware that the Website files, content, etc, cannot be exported if you decide to change your Hosting Provider you must create the website from scratch. EZD Hosting is an annual service that helps our clients keep their sites safe and fast. We use the builder Cheetah and we cannot provide access to the admin control panel if you want to design or work on your website content. We offer the EZD Web administration service that will allow you to request unlimited changes and modifications you need plus other services or you can use the EZ WEB Hourly of 79 USD. If you wish to have admin control and be able to edit your site, you must acquire Builderall here:

EZ Deals will transfer the Website to your Builderall Account for you to administrate. With this software, the client will be able to administrate and edit the website and EZ Deals will no longer be responsible for the Website support and security.

If the client does not get the EZD hosting service, he/she must purchase the domain, the hosting, and the SSL certificate.

The clients can request to Whitelabel the website (remove the word EZ Deals from all the pages) for a one-time payment of 100 USD.

The clients can request special programs under our native code development by requesting a quote. The code developed is the property of EZ Deals. If the clients wish to migrate the code they must purchase it separately from the payment of this Service.

EZ APP: EZ Deals App Development

EZ Deals can create Apps utilizing our client’s specifications, texts, images, videos, and Logos.

Our clients must provide us with the credentials or admin access to their VPS. Alternatively, EZD Deals can offer VPS hosting for an additional price. Once all of the above have been provided, EZ Deals will deliver the website within 30 business days. Clients have 3 business days to notify of any necessary modifications needed concerning colors, image positioning of text and information to be displayed.

The Client must purchase the domain, the hosting, and the SSL certificate.

The clients can request to Whitelabel the App (remove the word EZ Deals from all the pages) for a one-time payment of 100 USD.

Additional widgets, plugins, forms, pages, or web support that are not covered by the original service agreement between the client and EZ Deals will be charged separately at our standard hourly rate of 79 USD. A quote can be requested before any alterations and additions happen.


EZ Deals clients have a responsibility to ensure their campaign goes live within a year, so as not to forfeit any funds already paid.




EZ Social: the EZ Deals Social media management service.

EZ Social service includes:

a) Content development:
– Creating posts.
– Edit posts, videos, photos provided by the client, and free copyright.
b) Engagement:
Following of other pages within the same industry, posting of small comments, replies to a minimum of 5 comments on the posts made by the EZ Social Team.
c) Initial strategy concept, subsequent strategy review with any necessary development every 3 months.

The strategy cannot be changed once agreed upon as the content work is based on the strategy.


The client must provide the credentials of the social media platforms to be managed or provide administrator permission access. Alternatively, EZ Social can create new accounts together with an email exclusively dedicated to the EZ Social work company.ezsocial@gmail.com.

The client commits to having good communication through email and a WhatsApp group. If the client has no WhatsApp we will use only email. However, using only emails is likely to result in a slower response time for both the EZ Social Team and the Client.

The client commits to sharing content and uploading it to a shared Google Drive.

EZ Social Team does not alter the algorithm of the social media platforms to increase likes or followers, and adheres strictly to the organic growth of the following.



EZ Visual

EZ Visual: EZ Deals Visual and Graphic Designers team.

EZ Visual creates Logos, flyers, posters, banners, social media images, Facebook covers, and animated videos. We edit videos, photos, and images based on our client’s instructions.

The client will receive a quote based on their request, this includes an estimated time of delivery.
The client has 3 business days in which to request any modifications. Modification requests received after the three-day period will be charged under our Graphic Design hourly rate of 59USD. Alternatively, the client can request a new quote before alterations are undertaken.

The client can always request a Whitelabel for 100 USD. This is a 1-time fee on every Visual File.



EZ Talent: EZ Deals Staff Service.

EZ Talent is a division of EZ Deals that provides our clients with bilingual agents to work as telemarketers, customer service representatives, and administrative assistants, with rates based on the tasks and times, agreed upon with our clients.

EZ Talent agents will adjust to our client’s software after undergoing full training.

EZ Talent agents will have active and open communication for any feedback to EZ Deals. The client can arrange a monthly meeting with EZ Deals to discuss possibilities of improvement, new services, products, tools, new procedures or policies.
EZ TALENT SERVICE AGREEMENT
This Service Agreement (the “Agreement”) is made and entered into as of the Effective Date (as defined below) by and between EZ Deals also known as EZ Talent, and the Client (“Client”).
In consideration of the mutual covenants and agreements contained herein, the parties agree as follows:
Services. EZ Talent agrees to provide to Client the following services (the “Services”):
Virtual Assistant(s), Telemarketer(s) and/or Customer Service Agent(s) that the client has selected along with the Times (shifts) and Tasks. The Client can customize the Tasks and Times for the Agents to work with the Client’s company.
Training. Depending on the complexity of the tasks, the software and other programs, we will use the first hours or days to properly train your EZ Talent Agent.
The Client commits to provide all the virtual tools, credentials, and training material to ensure a good performance from EZ Talent Agents; (b) Supervise and coach EZ Talent Agents; and (c) Protect the data of the Client, its customers, and vendors.
Fees. Client shall pay EZ Talent the following fees for the Services:
1. (a) Deposit. A deposit of 500 USD is required for each EZ Talent agent hired.
2. (b) Advance Payment. The client will be charged in accordance with the agreed hours and rate for their selected EZ Talent agent(s). This is an automatic charge, to be paid one week in advance, prior to the EZ Talent service commencing, and continuing weekly. The number of hours and rate are established and agreed with the EZ Deals CEO or VPs of EZ Deals. (b1. Part-time is a minimum of 20 hours weekly, b2. Full-time is a minimum of 40 hours weekly).
3. Training. EZ Deals agents may require a training period on certain tasks requested by the client, such as learning new software or CRM system. The difficulty of the required task will determine how long the training period is likely to be. EZ Deals management will give an estimate on probable time needed, with an ongoing evaluation of learning progress. This training period will be charged at the normal agreed hourly rate.
Confidentiality. EZ Talent agrees to keep confidential all information relating to Client, its customers, and vendors, and to use such information only for the purpose of providing the Services.
Term and Termination. This Agreement shall commence on the Effective Date and shall continue in full force and effect for a period of one (1) year (the “Initial Term”). Unless earlier terminated in accordance with this Section 5, this Agreement shall automatically renew for successive one-year terms (each a “Renewal Term”) unless either party provides written notice of non-renewal to the other party at least thirty (30) days prior to the end of the Initial Term or any Renewal Term.
Either party may terminate this Agreement at any time for any reason upon thirty (30) days written notice to the other party.
Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Severability. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect.
Waiver. No waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties.
Refunds. EZ Deals and EZ Talent do not provide any full or partial refunds.
Headings. The headings in this Agreement are for convenience only and shall not affect its interpretation.
Attorneys’ Fees. In the event of any action to enforce this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs.
Counterparts. This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

Beacons that run Bluetooth marketing campaigns, in minutes – engage, interact and enhance customer experience.
Return Policy:
Stamps, Beacons, and/or NFC Key Tags must be returned by the appropriate date as provided herein.
1. If our client’s campaign cancellation End Date is on or before the 15th of the month, the device(s) will need to arrive at our client’s local EZ Deals office or be given to their EZ Deals representative by the last day of that month.
2. If our client’s campaign End Date is after the 15th up to the last day of the month, the device(s) will need to arrive at our client’s local EZ Deals office or be given to their EZ Deals representative by the 15th of the following month.
3. The End Date of our client’s campaign will be determined by the campaign’s “start date” (when the purchase order is finalized and EZ Deals receives payment).
4. If the device(s) are not returned by the appropriate date, EZ Deals will consider them to be lost and will charge the client $100 for each device.
All lost, broken or stolen EZ Deals hardware should be reported to EZ Deals immediately. EZ Deals will replace this hardware, following the procedure and terms below:
1. If a client loses a device the client will be charged $100 for each device.
2. EZ Deals must collect $50 for each broken device given back to us from our client.
3. Replacement of the beacon battery is free of charge when we receive the beacon(s) from our clients.
4. The client will pay all shipping charges for replacement hardware, including expedited shipping fees, if requested.
5. Lost or stolen hardware ID numbers must be reported to EZ Deals support via email: info@ezdeal.co
6. EZ Deals will suspend the subscription service applicable to this hardware with reported ID within 3 business days and will notify client once this step is completed. This hardware ID will not be included in the next billing cycle or future billing cycles.
7. The hardware will be replaced with new hardware and a separate invoice for an activation fee per hardware item and associated shipping charges will be sent to the client – The new hardware will be registered to the EZ Deals account associated with the lost or damaged hardware.
8. Hardware will be shipped to the original client shipping address unless otherwise directed.
9. Our client may pre-purchase replacement hardware inventory (up to 10% of the total hardware service plans purchased to date) for the monthly fee of that hardware. This replacement hardware will not be registered to the clients account until the lost or damaged hardware ID is removed.
10. The replacement hardware will assume the continuation of the current subscription plan term of the lost or damaged hardware.
CANCELLATION POLICY.
EZ Deals provides our clients with the option to use our services on a month-to-month basis or with a 6-month or 1-year agreement. Our clients will not be reimbursed for any months not used within their campaign agreement if they decide to cancel their digital campaign ahead of their agreed schedule. Clients will not be charged any additional fees as long as they cancel their campaign 3 business days before the next recurring payment is scheduled to be deducted. (e.g., a recurring payment on August 13th will be deducted again on September 13th, and so on, every following month). Cancellations must be done by filling out this cancellation form https://b24-3t4ol7.bitrix24.site/feedback/. All equipment must be returned as provided above in the Return Policy. EZ Deals Campaigns cannot be transferred to another entity.
If you dispute a charge for your subscription, we may take steps to protect ourselves, including but not limited to:
• Suspending your account.
• Deleting your account.
• Reporting the dispute through merchant services.
• Using a 3rd party collections agency.
• Taking your company to court.
• EZ Deals will charge $50 per chargeback and late payments for Administration fees.
We reserve the right to take any other action we deem necessary to protect our business.
